Lepoidevin was hired by Nancy's Floral in 2012 and did not disclose her history of "seizures, blackouts, epilepsy, and/or 'déjà vu' moments" dating back to the late 1990s, according to the lawsuit. Nancy's didn't ask Lepodevin about the seizures or related medical problems during the hiring process or during the course of her employment, Dummigan wrote.Lepoidevin had tried to find employment as a TriMet driver before 2012 but was denied because she had disclosed her history of seizures, the lawsuit said.In November 2015, Portland police cited Lepoidevin for reckless driving with an accident, an accusation that was later dismissed in court after she completed an online traffic school course, court records show.Lepoidevin was prescribed a lower dosage of her medication a week before the crash with Orozco-Hernandez, according to the lawsuit. "A day or so" before the crash, she'd also had a seizure and was unaware it had happened until being told of it by her husband, according to the lawsuit.The delivery driver never informed her employer about the medication change and, on the day of the crash, she experienced two seizures without noticing, Dummigan wrote.She was "informed of them (seizures) by a passenger who was riding in the deliver van belonging" to Nancy's Floral, according to the lawsuit. The passenger, who was aware of Lepoidevin's medical history, asked her to pull over, but she kept driving, according to the lawsuit.Despite a red light and the teens legally crossing a marked crosswalk on Kane Street, Lepoidevin "did not stop, slow, or brake the van" before the crash, Dummigan wrote.Dummigan claimed negligence by Nancy's Floral for failing to inquire about Lepoidevin's medical history, for entrusting her to drive the van and for negligent training and supervision.1-800-Flowers, as the franchise company, "controlled essential functions of their franchisee's business operations," including scheduling delivery trucks, advertising delivery services and 28 other functions, according to the lawsuit. The company is liable, Dummigan wrote.Dummigan did not return a message left for him Wednesday morning. Nancy's and 1-800-Flowers declined to comment.It's unclear whether the criminal investigation into the crash has concluded, and a message left by a reporter with the Multnomah County District Attorney's Office was not returned.
